NEWS RELEASE: RETAIL GROCERY JLC RETENTION IS FLAWED: RGDATA WARNS MINISTER
Today (11 February) RGDATA, the representative body for the independent retail grocery sector in Ireland, warned Minister Richard Bruton that the decision to retain the Retail Grocery JLC is legally flawed as it supports some of the core aspects of the previous structure which were struck down by the High Court.
In a letter to the Minister, RGDATA advised that any new Employment Regulation Orders issued by a reinstated Retail Grocery JLC will be vulnerable to legal challenge and could be stuck down by the courts.
According to RGDATA, this is because it involves a level of discrimination between different businesses operating alongside each other without any justification for doing so. It also involves imposing discriminatory terms between employees of different businesses in positions of equivalence.
"RGDATA believes that this is a disasterous decision. It will add to employment costs, limit the capacity of business owners to respond to challenging trading conditions on a local or regional basis and will fundamentally undermine the competitiveness of the independent retail grocery sector", said Tara Buckley, RGDATA, Director General.
